1. Service Provider

Nooze Alarm is provided by its developer under the laws of the Republic of Bulgaria (“Provider”). Contact: noozesupport@gmail.com.

2. Description of Service

Nooze Alarm is an application for alarm management, sleep tracking, and gamification of daily habits. The Application offers:

• Alarm setup and management (no snooze by design);
• Sleep recording and analysis via accelerometer, microphone, and Health Connect;
• Smart wake (wakes you during light sleep within your chosen window);
• Sleep and mood journal;
• Achievement, level, and quest system;
• Social features (friends, leaderboards, wake duels);
• Sleep sounds and bedtime reminders;
• Smart home integration;
• Paid Premium features (“Nooze Premium”).

3. Acceptance of Terms

Access to and use of the Application is provided on the condition that you accept and comply with these Terms. The Terms apply to all visitors, users, and other persons accessing or using the Application. The minimum age to use the Application is 16 years.

4. User Account

4.1. Upon registration you provide true, accurate, and complete information. You are responsible for maintaining the confidentiality of your password.

4.2. It is prohibited to use another person’s credentials, share your account with third parties, or register accounts for fraudulent purposes.

4.3. Upon account deletion, all personal data will be irreversibly deleted in accordance with Art. 17 of the GDPR (Regulation (EU) 2016/679).

5. License to Use

The Provider grants you a limited, non-exclusive, non-transferable license to install and use the Application on one mobile device for personal, non-commercial purposes. Decompiling, reverse engineering, distributing, or commercializing the Application without the Provider’s express written consent is prohibited.

6. Paid Services (Nooze Premium)

6.1. Nooze Premium is a subscription service providing additional features for a monthly or annual fee.

6.2. Prices are set in the Application and are subject to change with 30 days’ notice.

6.3. Payments are processed through Google Play Billing. The Provider does not store payment card data.

6.4. Subscriptions may be cancelled at any time. Upon cancellation, Premium features remain active until the end of the paid period.

6.5. The right of withdrawal (14 days) is governed in accordance with applicable consumer protection law. For digital content where you have explicitly consented to immediate access, the right of withdrawal may not apply.

7. Device Permissions

The Application may request the following permissions:

• Microphone – for snore detection at your discretion;
• Alarms / Exact Alarms – to ring the alarm at the precise time;
• Notifications – for reminders and alarms;
• Accelerometer – for tracking movement during sleep;
• Internet – for synchronisation and social features.

Each permission is granted voluntarily. Denying a permission may limit certain features but does not block use of the Application.

8. Availability

The Application depends on your device hardware, operating system, and Android alarm scheduling APIs. We make no guarantee that alarms will fire under all conditions (e.g. battery optimisation, manufacturer-specific restrictions, or OS updates may affect alarm delivery). It is your responsibility to verify critical alarms and, where necessary, use a secondary alarm device.

9. Limitation of Liability

9.1. The Application is provided “as is” and “as available” without any warranties.

9.2. To the maximum extent permitted by applicable law, the Provider is not liable for direct or indirect damages resulting from the use or inability to use the Application, including loss of data, lost profits, or missed alarms.

9.3. Nooze Alarm does not replace medical or health advice. Sleep-tracking data is informational and is not a diagnostic tool.

10. Smart Home Integration

If you choose to enable Smart Home integration, the Application will send event data (alarm fired, sleep started/ended) to third-party platforms explicitly selected and configured by you (e.g. Home Assistant, custom webhooks). The Provider has no control over those platforms’ data practices. No smart home data is sent without your explicit configuration.

11. Intellectual Property

All rights in the Application, including source code, design, graphics, logo, the name “Nooze Alarm”, and content, belong to the Provider or to licensors and are protected by applicable copyright and intellectual property law.

12. Prohibited Conduct

When using the Application the following are prohibited:

• Infringement of third-party rights;
• Posting unlawful, offensive, discriminatory, or harmful content;
• Attempts at unauthorised access to servers or data;
• Use of bots, scrapers, or automated scripts;
• Abuse of payment systems or filing unjustified chargebacks.

13. Termination

The Provider reserves the right to suspend or terminate your access to the Application immediately, without notice, if you breach these Terms. Upon termination your right to use the Application ceases immediately.

14. Changes to the Terms

The Provider may update these Terms. For material changes you will be notified via the Application or by email no less than 14 days before they take effect. Continuing to use the Application after that date constitutes acceptance of the new Terms.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Bulgaria. All disputes shall be referred to the competent court in the Republic of Bulgaria. Users may also refer disputes to the relevant consumer protection authority or an alternative dispute resolution body in accordance with applicable law and EU Directive 2013/11/EU.
